The facts
The jury rejected the plaintiffs' case against Monsanto. Reuters reported that its journalist watched the trial and verdict through Courtroom View Network. [1]
Theresa Aretino, Cynthia Fernandez and Betty Larkin sued in 2020, alleging that regular Roundup use caused their non-Hodgkin lymphoma. Fernandez died before trial. The women were not participating in the proposed settlement. [1]
Their case alleged defective design, an unreasonably dangerous product and negligence. Bayer denied the claims. [2][1]
The proposed US$7.25 billion settlement concerns other Roundup cases and remains before a Missouri judge. This verdict does not itself approve that agreement. [1][2]
Relevant context
On 25 June, the Supreme Court held in Monsanto v. Durnell that federal pesticide law preempted Durnell's state-law failure-to-warn claim because it would require a cancer warning beyond the EPA-approved label. That decision and this trial verdict are distinct legal events. [3]
Still unconfirmed
- The settlement's approval and the outcomes of remaining cases are unresolved.
